माननीय दिल्ली उच्च न्यायालय ने दूरसंचार विभाग पर 10,000 रुपये का जुर्माना लगाया।

न्यायालय द्वारा दिए जा रहे निर्णयों को लागू न करने के तरीके और साधन ढूंढ़ना दूरसंचार विभाग की आदत बन गई है। इसका एक उत्कृष्ट उदाहरण माननीय सर्वोच्च न्यायालय द्वारा दिया गया निर्णय है, जिसमें दूरसंचार विभाग को बीएसएनएल के गठन से पहले दूरसंचार विभाग द्वारा भर्ती किए गए और प्रशिक्षण के लिए भेजे गए कर्मचारियों को प्रेसिडेंशियल ऑर्डर जारी करने का निर्देश दिया गया था। दूरसंचार विभाग इस निर्णय को केवल उन कर्मचारियों के लिए लागू कर रहा है जिन्होंने वास्तव में मामला दायर किया था। यह माननीय सर्वोच्च न्यायालय के निर्णय को कमजोर करने के अलावा और कुछ नहीं है। अब, हमें यह जानकर खुशी हुई कि माननीय दिल्ली उच्च न्यायालय ने दूरसंचार विभाग पर 10,000 रुपये का जुर्माना लगाया है। सभी जानते हैं कि माननीय प्रिंसिपल कैट, नई दिल्ली ने बीएसएनएल सेवानिवृत्त लोगों के पेंशन संशोधन पर एक ऐतिहासिक निर्णय दिया था। चूंकि दूरसंचार विभाग ने निर्णय को लागू नहीं किया, इसलिए पेंशनभोगी संघों ने दूरसंचार विभाग के खिलाफ अवमानना ​​कार्यवाही शुरू की है। इस स्थिति में दूरसंचार विभाग ने माननीय दिल्ली उच्च न्यायालय में अवमानना ​​कार्यवाही पर रोक लगाने की प्रार्थना करते हुए याचिका दायर की। इस मामले की सुनवाई माननीय दिल्ली उच्च न्यायालय में माननीय न्यायमूर्ति रेखा पल्ली और माननीय न्यायमूर्ति सौरभ बनर्जी ने की। दूरसंचार विभाग की दलीलों को सुनने के बाद माननीय उच्च न्यायालय ने अवमानना ​​कार्यवाही पर रोक लगाने से इनकार कर दिया। इतना ही नहीं, माननीय दिल्ली उच्च न्यायालय ने दूरसंचार विभाग पर प्रत्येक आवेदन के लिए ₹10,000 का जुर्माना लगाया है। माननीय न्यायालय ने आदेश दिया है कि यह जुर्माना राशि उच्च न्यायालय के कर्मचारियों को दी जाएगी। 

Com. Animesh Mitra, President, Com.John Verghese, Acting GS and Com.C.K.Gundanna, AGS, met Shri S.P.Singh,PGM(Estt.) on 30-05-2024 and discussed the non-Payment of Gratuity to the deceased official’s family in Karnataka circle. It was pointed out that, despite clear orders on the calculation procedure, the ERP system is not accepting the formula. The PGM (Estt.) assured that suitable instructions would be issued to the ERP Section to correct the calculation procedure and ensure payment to the family.

It has become the practice of the DoT to find ways and means for not implementing the judgements being given by the courts. A classic example is the judgement delivered by the Hon’ble Supreme Court, directing the DoT to issue Presidential Orders to the employees recruited and sent for training by the DoT, before the formation of BSNL. The DoT is implementing this judgement only for the employees who actually filed the case. This is nothing but dilution of the judgement of the Hon’ble Supreme Court. Now, we are glad to know that, the Hon’ble Delhi High Court has slapped a fine of ₹10,000/- on the DoT. All are aware that the Hon’ble Principal CAT, New Delhi, had delivered a landmark judgement on pension revision to BSNL retirees. Since the DoT did not implement the judgement, the pensioners’ associations have initiated contempt proceedings against the DoT. Under this situation, the DoT filed a petition in the Hon’ble Delhi High Court, praying to stay the contempt proceedings. This case was heard in the Hon’ble Delhi High Court by Hon’ble Justice Rekha Palli and Hon’ble Justice Saurabh Banerjee. After hearing the pleadings of the DoT, the Hon’ble High Court refused to stay the contempt proceedings. Not only that, the Hon’ble Delhi High Court has slapped a fine of ₹10,000/- on the DoT for each application it has filed. The Hon’ble Court has ordered that this fine amount will go to the High Court staff.

The Establishment Branch of the Corporate Office has issued letter on 28-05-2024, addressed to all the CGMs, directing them to intimate the estimated vacancies that are likely to arise in the cadre of JE(T) from 01-01-2024 to 31-12-2024. The Corporate Office letter states that,  the vacancies which are likely to arise due to retirement, promotion, resignation, death, etc. maybe intimated to the Corporate Office within three weeks. The Corporate Office letter is enclosed here with. All the circle secretaries, and CHQ office bearers are requested to contact their respective CGM offices and to ensure that, the data called for by the Corporate Office is sent within the stipulated time.

The government of India has decided that, the interest rate for the Employees Provident Fund (EPF) will be 8.25% for the year 2023-24. The Employees Provident Fund Organisation (EPFO) has issued letter on 31-05-2024, communicating this decision of the government of India. Copy of the order of the EPFO is enclosed for the information of our comrades.

Com.E.Gomathynayagam, Telecom Technician, Coimbatore, has donated Rs.5,000/- to the CHQ, on the day of his retirement on superannuation on 31-05-2024. Right from the day of his appointment as a Regular Mazdoor in the Nilgiris SSA, Tamil Nadu, Com.E. Gomathynayagam has been an active member of BSNLEU. The CHQ of BSNLEU heartily congratulates, Com.E.Gomathynayagam and wish him a long and happy retired life.

30-05-2024 को आयोजित समूह स्वास्थ्य बीमा बैठक का विवरण।

30.05.2024 को कॉर्पोरेट कार्यालय में समूह स्वास्थ्य बीमा योजना के नवीनीकरण के संबंध में बैठक आयोजित की गई, जिसकी अध्यक्षता श्री संजीव त्यागी, प्रिंसिपल जनरल मैनेजर (प्रशासन) ने की। बैठक में BSNLEU की ओर से अध्यक्ष साथी अनिमेष मित्रा, कार्यवाहक महासचिव साथी जॉन वर्गीस, सहायक महासचिव सीके गुंडाना और संगठन सचिव (सीएचक्यू) साथी अश्विन कुमार ने भाग लिया।

बैठक में BSNLEU ने प्रीमियम में 1.27 गुना वृद्धि का विरोध किया और मांग की कि पुरानी दरें जारी रहनी चाहिए। सभी यूनियनों और एसोसिएशनों ने मांग की कि माता-पिता की श्रेणी में नए प्रवेशकों के लिए लागू 20% सह-भुगतान प्रबंधन द्वारा वहन किया जाना चाहिए। इस संबंध में आगे की चर्चा जारी रहेगी।
