अंततः, BSNLEU द्वारा, नॉन एग्जीक्यूटिव्ज के IDA फ्रीजिंग पर रोक लगा दी गई। BSNLEU द्वारा दायर प्रकरण में, माननीय केरल उच्च न्यायालय द्वारा DPE को कहा गया है कि DPE के IDA फ्रीजिंग आदेश केवल  एग्जीक्यूटिव्ज और नॉन यूनियनाइज्ड सुपरवायजर्स के लिए ही लागू है। अतः,  नॉन एग्जीक्यूटिव्ज को IDA भुगतान से वंचित नही किया जाए, न्यायालय ने कहा है। यह, नॉन एग्जीक्यूटिव्ज को IDA भुगतान हेतु आदेश जारी करने के लिए, DPE को स्पष्ट निर्देश हैं। इस न्यायालयीन आदेश के  पश्चात, अब, DPE , और अधिक टालमटोल नही  कर सकता है, बल्कि, IDA भुगतान हेतु उसे आदेश जारी करना ही होंगे। हम, माननीय केरल उच्च न्यायालय द्वारा प्रेषित आदेश की प्रति संलग्न कर रहे हैं।   

ट्रेड यूनियन के नाम पर मनोरंजन क्लब चलाने वाले, अब BSNLEU का उपहास नही कर सकेंगे...

IDA फ्रीजिंग के प्रकरण में माननीय केरल उच्च न्यायालय में चल रही सुनवाई जब समापन की ओर थी, सहायक महाधिवक्ता (Assistant Solicitor General) को आभास हो गया था कि  न्यायालय का फैसला BSNLEU के पक्ष में ही होगा। अतः, उनके निर्देश पर, DPE ने स्पष्टीकरण जारी किया कि IDA फ्रीजिंग वर्कमैन पर लागू नही होगा।  BSNLEU द्वारा यह दावा किया गया कि, उनके द्वारा न्यायालय में दायर प्रकरण की वजह से निर्मित दबाव की वजह से ही, DPE द्वारा यह स्पष्टीकरण जारी किया गया। इसके तुरंत पश्चात, कुछ लीडर्स , जो ट्रेड यूनियन के नाम पर मनोरंजन क्लब चला रहे हैं, ने व्हाट्सएप संदेशों के माध्यम से BSNLEU का उपहास करना शुरू कर दिया। लेकिन, अब यह साबित हो गया है कि BSNLEU एक चैंपियन यूनियन है, जो कर्मचारियों के अधिकारों की रक्षा के लिए संघर्ष करती है। 

When the CHQ of BSNLEU decided to file a case against IDA freezing, it decided to file it in the Hon’ble Kerala High Court. This is because, the Hon’ble Kerala High Court had already given a favourable judgement in the case filed by FACT workers union. For certain reasons, the case was filed through the Kerala circle union of BSNLEU. The Kerala circle union and it’s circle secretary, Com.C. Santhosh Kumar, did an excellent job in filing the case, by engaging a very good advocate. The expeditious actions taken by Kerala circle union has brought relief to the entire BSNL employees. The CHQ of BSNLEU heartily congratulates Com.C. Santhosh Kumar, Circle Secretary, BSNLEU, Kerala circle. The CHQ also appreciates and sincerely thanks Shri V.V. Suresh, Advocate, Kerala High Court, for getting this favourable order.

When the hearing was coming to an end in the Kerala High Court, on the IDA freezing case, the Assistant Solicitor General, understood that, the court order will come in favour of BSNLEU. Hence, as per his direction, the DPE issued a clarification, stating that the IDA freezing is not applicable to the workmen. BSNLEU claimed that this clarification was issued by the DPE, only because of the pressure created by BSNLEU through the court case. Immediately some leaders, who are running recreation club in the name of trade union, ridiculed BSNLEU through WhatsApp messages. But, it is proved now that, BSNLEU is the champion, which fights to safeguard the rights of the employees.

Finally, BSNLEU has stopped the freezing of IDA to the Non-Executives of BSNL. In the case filed by BSNLEU, the Hon’ble Kerala High Court has told the DPE, that the DPE’s order for freezing IDA is applicable only to the Executives and Non-Unionised Supervisors. Hence, payment of IDA should not be denied to the Non-Executives, the court has said. This is a clear-cut direction to the DPE to issue order for payment of IDA to the Non-Executives. After this court order, the DPE cannot dilly-dally anymore, but has to issue order for payment of IDA. We are attaching herewith a copy of the order delivered by the Hon’ble Kerala High Court.

A meeting of the BSNL Working Women’s Coordination Committee (BSNLWWCC) is held online today. Com.Rama Devi, presided over the meeting. At the outset, the meeting greeted Com. Rama Devi, who is recently elected as the circle secretary of Andhra Pradesh and Com. Amita Nayak, who is recently elected as the District Secretary of Goa. Com.P. Indira, Convenor, welcomed everyone and placed the report on activities. Com.P.Abhimanyu, GS, delivered the inaugural address and spoke on the issues being taken up by the BSNLEU, the budget of the Central Government, farmers’ agitation and the repression being let loose by the Modi government, etc. Thereafter, the members participated in the discussion, based on the report submitted by the Convenor. After the concluding remarks made by the General Secretary, the discussions were summed up by Convenor. The meeting decided to effectively organise the forthcoming International Women’s Day celebrations. The meeting also decided to organise an online Seminar on the International Women’s Day. 

IDA फ्रीजिंग के विरोध में BSNLEU का प्रकरण- माननीय केरल उच्च न्यायालय द्वारा अंतरिम आदेश जारी....

BSNLEU द्वारा, नॉन एग्जीक्यूटिव्ज को देय IDA की तीन किश्तों की  फ्रीजिंग के आदेश को चुनौती देते हुए, माननीय केरल उच्च न्यायालय में प्रकरण दायर किया गया था। इस प्रकरण में माननीय केरल उच्च न्यायालय द्वारा एक अंतरिम आदेश पास किया गया है। माननीय उच्च न्यायालय द्वारा पुनः कहा गया है कि IDA फ्रीजिंग केवल  एग्जीक्यूटिव्ज और नॉन यूनियनाइज्ड सुपरवायजर्स के लिए ही लागू है,  BSNL के नॉन एग्जीक्यूटिव्ज के लिए नही। साथ ही, माननीय न्यायालय द्वारा, स्पष्ट रूप से यह भी आदेशित किया गया है कि याचिकाकर्ता यूनियन (Petitioner Union) के सदस्यों को IDA के लाभ से वंचित नही किया जाए। अब, सरकार के पास अन्य कोई विकल्प नही है, सिवा इसके कि, BSNL के नॉन एग्जीक्यूटिव्ज को IDA की किश्तों का भुगतान किया जाए। आगामी कार्यवाही हेतु, CHQ, माननीय उच्च न्यायालय के आदेश की प्रमाणित प्रतिलिपि हेतु प्रतीक्षारत है। सर्किल और डिस्ट्रिक्ट सेक्रेटरीज से अनुरोध है कि यह जानकारी सभी साथियों में व्यापक रूप से प्रसारित करें। 

BSNLEU has filed case in the Hon'ble Kerala High Court, challenging the freezing of 3 instalments of IDA to the Non-Executives of BSNL. In this case, the Hon'ble Kerala High Court has passed an interim order. The Hon’ble Court has reiterated that, the IDA freezing is applicable only to the Executives and Non-Unionised supervisors and not to the Non-Executives of BSNL. Further, the Hon’ble Court has categorically ordered that, the benefit of IDA should not be denied to the members of the Petitioner Union. Now, the government has no other option, but to pay the instalments of IDA to the Non-Executives of BSNL. CHQ is awaiting the certified copy of the Hon’ble Court order, for further action. Circle and District secretaries are requested to widely circulate this news among the employees.
