Employees recruited and sent for training by the DoT - denial of the benefit of the Hon'ble Supreme Court order dated 26-07-2024 - BSNLEU writes letter to shri Jyothiraditya Scindia, Hon'ble Minister of Communications and seeks his kind intervention..

A section of the BSNL employees are originally recruited and sent for training by the DoT. However, by the time they completed their training, BSNL is formed. All those employees are appointed in BSNL. However, since they are recruited by the DoT, they should have been treated as DoT recruitees and Presidential Orders should have been issued to them. But, they were treated as BSNL recruitees only. BSNLEU took up their case and argued before BSNL Management and the DoT. However, DoT did not accept BSNLEU's demand. Under this situation, a section of the affected employees approached various benches of the Hon'ble CAT. Hon'ble CATs delivered judgement in favour of the affected employees. Against these judgements, BSNL appealed in the respective Hon'ble High Courts. All the Hon'ble High courts also gave judgment in favour of the employees. Thereafter, BSNL Management appealed in the Hon'ble Supreme Court of India. Finally, on 26-07-2023, the Hon'ble Supreme Court of India also delivered judgement in favour of the affected employees. But, on 22-2-2024, the DoT issued an order stating that, the benefit of the Hon'ble Supreme Court order dated 26-07-2024 would be implemented only in respect of the employees who filed case in the court. This order denies the benefit of the Hon'ble Supreme Court order to the affected employees who did not approach the court. BSNLEU is continuously raising this issue with the BSNL Management and the DoT. Today, BSNLEU has once again written letter to shri Jyotiraditya Scindia, Hon'ble Minister of Communications, requesting him to intervene in this matter and to ensure implementation of the order of the Hon'ble Supreme Court dated 26-07-2023, to the affected employees, irrespective of whether they have filed case in the court or not.
