Constitution is supreme, says Justice Shri Gavai, the new Chief Justice of the Supreme Court..

The newly appointed 52nd Chief Justice of India, Justice Shri Gavai has stated yesterday that, the Constitution is supreme. He has also stated that the Parliament has the power to amend the Constitution, but it cannot amend the “basic structure of the Constitution”. The Chief Justice further stated that, the ‘basic structure doctrine’ holds that certain fundamental features of the Constitution, such as it’s supremacy, the rule of law and independence of judiciary cannot be amended by the Parliament through a Constitutional Amendments. As we are aware, the judiciary, especially the Supreme Court is coming under increased attacks from the ruling party. Shri Jagdeep Dhankhar, Hon’ble Vice President of India, some time back, had questioned the authority of the Supreme Court.
